FiveArc Terms of Use

Effective date: October 13, 2026

These terms are an agreement between you and [YOUR FULL LEGAL NAME] (“I”, “me”), the developer of FiveArc (“the app”), covering the FiveArc iPhone app and website. By creating an account or using the app, you agree to these terms and to the Privacy Policy. If you don’t agree, don’t use the app.

1. Who can use FiveArc

You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you need permission from a parent or guardian, who agrees to these terms for you.

2. Not medical advice

FiveArc is a personal tracking and planning tool for general wellness. It is not a medical device and does not give medical, nutritional, dietary, fitness or other professional advice.

Goals, rings, trophies and totals in the app are general motivation, not recommendations for you personally.
Calories, protein and other nutrition figures are whatever you enter. The app does not check them.
Workouts imported from Apple Health may be incomplete or inaccurate.
Talk to a doctor or other qualified professional before starting a new exercise program or changing your diet, and especially if you are pregnant, have a medical condition, or have a history of disordered eating.
Never ignore professional advice or delay getting it because of something in the app. In an emergency, call your local emergency number.

3. Your account

Keep your password private and use one you don’t use elsewhere. You are responsible for activity on your account. Tell me at phisarys911@gmail.com if you think someone else has accessed it. You can delete your account at any time in Profile > Delete account.

4. Your content

Everything you enter (your profile, photo, entries and notes) remains yours. You give me only the permission needed to store it and show it back to you on your devices, as described in the Privacy Policy. That permission ends when you delete the content or your account, apart from backup copies that are removed on the schedule in the Privacy Policy.

Only upload a profile photo you have the right to use, and nothing illegal, hateful or sexually explicit.

5. Acceptable use

Don’t misuse the app. That includes trying to access other people’s accounts or data, interfering with or overloading the service, reverse engineering it except where the law allows, creating accounts by automated means, or using it for anything illegal.

6. Apple Health

If you connect Apple Health, the app reads your workouts as described in the Privacy Policy. You can turn this off at any time in the Health app. Apple Health and Apple Watch are provided by Apple, not by me.

7. Subscriptions

It must state the price, billing period, what Pro includes, that payment is charged to your Apple Account, that it renews automatically unless cancelled at least 24 hours before the end of the period, and how to manage or cancel in Settings > [your name] > Subscriptions. Free trial terms, if any, go here too.]

8. Changes and availability

I may change, add or remove features, and may suspend or end the app. If I end the app, I will give reasonable notice in the app where possible so you can copy anything you want to keep. I may update these terms; if a change is significant, I will tell you in the app before it takes effect. Continuing to use the app after that means you accept the new terms.

I may suspend or close an account that breaks these terms. You may stop using the app and delete your account at any time.

9. Disclaimer

The app is provided “as is” and “as available”. To the fullest extent the law allows, I make no warranties of any kind, express or implied, including that the app will be error free, always available, or that data will never be lost. Some places don’t allow these exclusions, so some may not apply to you.

10. Limitation of liability

To the fullest extent the law allows, I am not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the app. My total liability for any claim relating to the app is limited to the greater of the amount you paid me for the app in the 12 months before the claim, or US$50. Nothing in these terms limits liability that cannot be limited by law.

11. Governing law

These terms are governed by the laws of the State of [YOUR STATE], USA, without regard to conflict of laws rules. Disputes will be handled in the state or federal courts located in [YOUR COUNTY], [YOUR STATE], unless the law where you live gives you the right to bring a claim locally.

12. Apple App Store terms

If you downloaded the app from the Apple App Store:

These terms are between you and me only, not Apple. I, not Apple, am solely responsible for the app and its content.
Your license to use the app is limited to a non-transferable license on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
I am solely responsible for any maintenance and support for the app. Apple has no obligation to provide any.
If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the app. To the maximum extent the law allows, Apple has no other warranty obligation with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses due to any failure to conform to any warranty are my responsibility to the extent they are not disclaimed in these terms.
I, not Apple, am responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
If a third party claims that the app or your possession or use of it infringes their intellectual property rights, I, not Apple, am solely responsible for investigating, defending, settling and discharging that claim.
You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
You must comply with any applicable third-party terms (such as your mobile data provider’s) when using the app.
Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right (and will be deemed to have accepted the right) to enforce them against you as a third-party beneficiary.
